1. Who we are
Atelier App, Inc. ("Atelier," "we," "us"), a Delaware corporation, runs a curated marketplace for sustainable home design in Latin America. We connect home-design brands with interior designers, studios and customers. Atelier App, Inc. was formerly 0110 Atelier, LLC.
This policy covers personal data we handle through:
- our website, atelier-app.com, and any Atelier apps
- our marketplace, catalog and trade (designer and studio) accounts
- our social media accounts, including Instagram (@atelierhomeapp)
- email, chat and other ways you contact us
Atelier is the controller of your personal data, called the titular del banco de datos personales under Peruvian law. Contact us at hello@atelier-app.com or 108 Lewies Cir, Carbondale, CO 81623, USA.
2. Information we collect
We collect what you give us, what our systems record when you use our services, and what partners send us.
- You give it to us: name, email, phone, password, company or studio name, profession, delivery address, order details, project briefs, messages, reviews, photos and files you upload.
- Brands and suppliers: contact person, business details, tax ID (RUC), product catalog, prices, images and specifications.
- Collected automatically: device and browser type, IP address, approximate location, pages viewed, searches, clicks, time on page, referring site, cookie and pixel identifiers.
- Social media: your public username, profile picture, and the comments or messages you send to our accounts, received through Meta's Instagram API.
- Payments: payment status and the last digits of your card. Our payment processors, izipay and PayPal, handle full card and account details; we never receive or store them.
- Other partners: information from marketplaces and partners you reach us through (for example Mercado Libre), from Wix, and from analytics providers.
We do not intentionally collect sensitive data (health, religion, biometric data, political views). Please don't send it to us.
3. How we use information
We use personal data only for the purposes below, each tied to a legal basis.
- Create and manage your account, process orders, connect designers with brands: contract with you.
- Answer questions, comments and messages, including on Instagram: contract or your request; legitimate interest.
- Run, secure and fix our website and marketplace; prevent fraud: legitimate interest; legal obligation.
- Improve the catalog, search and recommendations: legitimate interest.
- Improve our AI assistant with your chats and interactions (section 4): your opt-in consent, which you can withdraw at any time.
- Send newsletters, promotions and event news: your consent; you can unsubscribe at any time.
- Measure site traffic and advertising: your consent (section 7).
- Meet tax, accounting and legal requirements: legal obligation.
If we want to use your data for a new purpose that isn't compatible with these, we'll tell you first and ask for consent where the law requires it.
4. Artificial intelligence and model training
We use AI to run parts of Atelier, including an assistant built on Claude, made by Anthropic. We use your chats and interactions to improve that assistant only if you opt in, and you can withdraw at any time.
How we use AI tools
- Writing, translating and organizing product descriptions and catalog data
- Powering search, recommendations and design suggestions
- Answering chats, comments and messages, including on Instagram. When our AI assistant replies, we say so.
- Analyzing site traffic, search trends and business performance
Our AI providers. Our assistant runs on Claude, from Anthropic. They process data only to deliver the service to us. We set our accounts so that providers do not use our data to train their own general AI models.
Improving our assistant with your data (opt-in only)
- What we use: if you opt in, your chats with our assistant and your interactions with Atelier, such as the questions you ask, the products you view or save, and your feedback on answers.
- How we use it: to write and refine the assistant's instructions, skills, example answers and knowledge of our catalog, so it serves customers and designers better. We don't use it to build advertising profiles.
- What we never use: passwords, payment details, government IDs or sensitive data.
- How we protect it: we remove names, contact details and other direct identifiers wherever we can before using a conversation as an example.
- How you opt in: through a separate, unticked consent box when you chat with us or create an account. Saying no doesn't affect your use of Atelier.
Data collected before this policy. We don't use chats or interactions from before October 12, 2026 to improve our assistant.
Your choices. Withdraw consent at any time by emailing hello@atelier-app.com. We'll stop using your data for this purpose and remove your conversations from our example sets within 30 days.
Automated decisions. We do not make decisions about you with legal or similarly significant effects based only on automated processing. If we ever do, we'll tell you, and you can ask for a human to review the decision.
5. Social media and Instagram
When you comment on or message our Instagram account, we receive that content through Meta's official Instagram API and use it only to respond to you and run our account.
- What we receive: your Instagram username, Instagram-scoped user ID, profile picture, and the text and media of your comments or messages to @atelierhomeapp.
- What we do with it: reply to you, follow up by private message when you ask about a product or project, and keep a record of the conversation. An AI assistant may help draft or send replies (section 4).
- What we don't do: we don't sell Instagram data, use it for unrelated advertising, or combine it with data from other sources to build profiles without your consent.
- Meta's role: Meta handles your data on Instagram under its own privacy policy. We follow Meta's Platform Terms for data we receive.
- Deleting your Instagram data: email hello@atelier-app.com with the subject "Delete my data" and your username. We'll delete the comments, messages and IDs we hold within 30 days and confirm by email. You can also delete your own comments on Instagram at any time.
6. How we share information
We do not sell your personal data, and we do not share it for cross-context behavioral advertising without your consent.
- Brands and suppliers on Atelier: to fulfill orders, quotes and designer requests you make.
- Designers and studios: when you ask to be connected with them.
- Service providers: website hosting (Wix), payments (izipay and PayPal), email and email marketing (Mailchimp), analytics, cloud storage and customer support. They act only on our instructions.
- AI providers: to run AI features under contract (section 4).
- Marketplace partners: when you buy through them (for example Mercado Libre). Their own policies apply.
- Authorities and courts: when the law requires, or to protect rights, safety and property.
- A buyer or successor: if Atelier is merged, acquired or sells assets. This policy keeps applying to your data.
We may share aggregated or de-identified data that can't reasonably identify you.
7. Cookies and similar technologies
We use cookies, pixels and local storage to keep you signed in, remember your cart and preferences, measure traffic and understand which ads work.
- Essential: required for the site to work. These are always on.
- Analytics: Wix Analytics and Google Analytics show us how people use the site. Some of these tools can record how you move through pages.
- Advertising: Google Ads, the Meta Pixel and Meta Conversions API, and the TikTok Pixel measure our ads and show Atelier ads elsewhere.
We ask for your consent before setting analytics or advertising cookies, and set none until you accept. You can change your choice in our cookie banner, or block cookies in your browser; some features may stop working. We respond to the Global Privacy Control signal as an opt-out where U.S. state law requires it.
8. International transfers
Atelier is a U.S. company serving users mainly in Peru, so your data may be stored or processed in the United States, Peru and other countries where our providers operate. When we transfer personal data across borders, we use safeguards required by law, such as contractual clauses with providers that ensure an adequate level of protection. Where Peruvian law requires it, we tell you and get your consent for the transfer.
9. How long we keep information
We keep personal data only as long as we need it for the purposes in this policy.
- Account data: while your account is open, plus 2 years after closure.
- Orders, invoices and tax records: as long as tax and accounting law requires, generally 5–10 years.
- Messages and Instagram conversations: 2 years after the last interaction, unless you ask us to delete them sooner.
- Marketing lists: until you unsubscribe.
- Analytics data: 26 months.
- Chats and interactions used to improve our assistant: until you withdraw consent, or 2 years after collection, whichever comes first.
When a period ends, we delete or anonymize the data.
10. Security
We use technical and organizational measures to protect personal data. These include encryption in transit, access controls, limited staff access, and choosing providers with recognized security practices. No system is perfectly secure. If a breach puts your rights at risk, we'll notify the authorities within the legal deadline (48 hours to Peru's data protection authority) and tell you without undue delay.
11. Your rights
You can ask us to access, correct, delete or stop using your personal data. Email hello@atelier-app.com; we'll verify your identity and respond within the deadlines set by law.
If you are in Peru, under Law 29733 and its 2024 regulation you have the right to:
- Access your data and know how we use it
- Rectify data that is inaccurate or incomplete
- Cancel (delete) data we no longer need or hold without a valid basis
- Object to processing, including for marketing and for improving our AI assistant
- Portability: receive your data in a structured, commonly used format
- Not be subject to decisions based only on automated processing that significantly affect you
- Withdraw consent at any time, without affecting earlier lawful processing
If you're not satisfied with our answer, you can file a complaint with Peru's National Authority for Personal Data Protection (Autoridad Nacional de Protección de Datos Personales, Ministry of Justice and Human Rights).
If you are in the United States, depending on your state you may have the right to access, correct, delete and get a copy of your data, and to opt out of targeted advertising and profiling. We won't treat you differently for using these rights. An authorized agent may make a request for you.
Everyone can unsubscribe from marketing using the link in any email, and withdraw consent to AI improvement (section 4).
12. Children
Atelier is meant for adults and businesses. We do not knowingly collect personal data from children under 14 in Peru, or under 13 in the United States, without a parent's or guardian's consent. If you believe a child has given us data, contact us and we'll delete it.
13. Changes and contact
This policy is available in English and Spanish. We'll post any update here with a new "last updated" date. For a material change, we'll notify you by email or a notice on the site at least 30 days before it takes effect. We won't apply a material change to data we already collected, such as a new use for AI training, without your consent.
